APL, one of the world’s largest ocean carriers, participates in the federal Maritime Security Program (MSP). The program offers subsidies to vessel owners and operators in exchange for their agreement to make their ships available to the military during a time of war or national emergency. From 2014 to 2016, the federal Maritime Administration approved APL’s requests to replace two of its vessels in the MSP fleet. One of APL’s competitors administratively appealed those decisions, and now seeks review of the agency’s denial of its appeal in the D.C. Circuit. In this brief, Goodwin attorneys argue that APL’s replacement vessels satisfy the statutory criteria for MSP eligibility.
