B&B Hardware v. Hargis Industries

Goodwin attorneys first became involved in this trademark case at the Supreme Court stage, successfully persuading the Supreme Court to grant review and reverse the Eighth Circuit. The Supreme Court held that adjudications by the Trademark Trial and Appeal Board  are entitled to issue preclusive effect if the ordinary standards of issue preclusion are satisfied. The decision is an important precedent both in trademark law, and for determining the preclusive effect of decisions by administrative agencies.
